Texas Attorney General Ken Paxton (R) is in agreement with opinions issued in ny, Illinois, and Nevada that daily fantasy sports (DFS) operators are in breach of state law and are operating gambling that is illegal.

In his response to a query made by Texas State Rep. Myra Crownover (R-District 64), Paxton linked the element of opportunity related to the competitions to gambling.

‘Paid daily ‘fantasy sports’ operators claim they could legally operate … but none of their arguments square with existing Texas law,’ Paxton wrote in a statement. ‘ since the outcome of games in daily dream sports leagues depends partially on chance, an individual’s re payment of the fee to be involved in such activities is just a bet.’

Unlike his colleagues in New York and Nevada, Attorneys General Eric Schneiderman and Adam Laxalt, Paxton didn’t announce any instant appropriate repercussions or purchase DFS market leaders DraftKings and FanDuel to cease operations in his state. Yet.

So You’re Telling Me There Is a Chance

Paxton isn’t terribly interested in venturing to the complicated debate of determining if day-to-day fantasy contests constitute gambling or competition that is skill-based. That’s because in his state, even the component that is slightest of chance overrides other factors.

‘Unlike several other states, Texas legislation just calls for ‘partial opportunity’ for something become gambling; it does not require that chance predominate,’ Paxton said.
